Property Dilapidations
Dilapidations describe items of disrepair where there is a legal liability on a landlord or tenant to maintain a property.
If you are a Landlord, BNE can ensure that your property is maintained as required by the lease and to maximise the value of your investment. By carrying out a detailed assessment of the state of repair and advising on any outstanding dilapidations works, BNE can assist in making sure your interests are protected and the premises restored to their proper condition.
BNE can also assist Tenants who are about to enter into a lease and help them minimise their future liability. If you have received a schedule of dilapidations, BNE can advise on how it should be dealt with cost-effectively and, where possible, seek relief on your behalf.

- Prepare a terminal or an interim schedule of dilapidations for landlords.

Lease Renewal
- The detailed analysis of a lease and supporting legal documentation with specific reference to any decorative and repairing covenants and advising either a tenant or landlord on the effect of the covenants on the condition and maintenance of a building.
- Inspecting a building in respect of the decorative and repairing covenants of a lease and with particular regard to any Licences for Alteration or Reinstatement and any works which have been undertaken of an unauthorised nature.
- Recording any outstanding dilapidations or breaches of covenant in a pre-requisite form which enables a formal dilapidations claim to be made in accordance with dilapidations protocol where applicable and which will include costs of remedying any breaches of covenant based on a schedule of rates or builders’ estimates.
- Arranging for the Schedule of Dilapidations and/or a Dilapidations Claim to be served on the appropriate party in consultation with the clients’ Legal Advisors.
- Negotiating a settlement on behalf of either the landlord or tenant with regard to a Dilapidations Claim under the current legal constraints and protocol and, where necessary, arranging for a Section 18(1) Valuation to be prepared under the Landlord and Tenant Act 1927 to enable an accurate assessment of the landlord’s damage to reversion due to the dilapidations to be properly quantified where applicable.
