Unless specifically excluded, all leases of commercial property in England and Wales have the protection of the Landlord & Tenant Act 1954 that gives security of tenure rights to tenants, but also gives landlords the right to deny tenants new leases on specified grounds.

Most lease renewal negotiations are settled by agreement. However, if not and the property is located within England or Wales, the matter will be heard by the appropriate court or, if unopposed, the parties can agree to appoint either and Expert or Arbitrator to determine the terms and rent payable for the new lease under the PACT Scheme.

If your case is contentious, BNE will advise you of the risks and rewards of pursuing court action or referring the matter to PACT to enable you to make an informed decision in the light of the likely outcome and cost of proceedings.
